Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a legal agreement between you and Mossen LLC, an Oregon limited liability company (“Mossen,” “we,” “us,” or “our”). They govern your access to and use of the Mossen mobile app, this website, and any related services (collectively, the “Service”).

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

2. Eligibility

To use Mossen, you must:

• Be at least 18 years old;
• Have the legal capacity to enter into a binding agreement;
• Not be barred from using the Service under applicable law or under any prior agreement with us; and
• Provide accurate registration information and keep it current.

The Service is currently available only in the Portland, Oregon metropolitan area. We may expand to additional metros in the future.

3. Your account

You’re responsible for maintaining the confidentiality of your account and for all activity that happens through it. Choose a strong password (or use the Sign in with Apple or Sign in with Google options), don’t share your credentials, and let us know immediately at admin@mossen.app if you suspect unauthorized use.

One account per person. Don’t impersonate anyone, create accounts on behalf of others without permission, or use the Service to help others evade a ban.

4. What Mossen is (and isn’t)

Mossen is a platform that helps neighbors connect around four kinds of exchanges: Shares (goods posted for sale, split among neighbors, or offered for free), Stashes (location-pinned notes or objects), Gatherings (in-person community events), and Rides (shared transportation, either splitting a commercial rideshare like Uber or Lyft or carpooling in a personal vehicle).

Mossen is not a party to any transaction, exchange, gathering, or ride between users. We provide the platform for users to find each other and communicate. We do not:

• Own, inspect, or take possession of any listed items;
• Process payments between users;
• Operate, own, insure, or drive any vehicle used in a Ride, nor act as a transportation provider or booker;
• Verify users’ identities beyond email verification;
• Guarantee the accuracy of listings, the quality of items, the safety of meetup locations, the safety of any ride, or the conduct of users;
• Endorse, sponsor, or approve any user, listing, Stash, Gathering, or Ride.

Users are solely responsible for their listings, their interactions with other users, the items they exchange, the meetups they organize or attend, and the rides they offer, accept, or join.

5. Meetup safety

When arranging in-person exchanges or gatherings, use good judgment. We strongly recommend:

• Meeting in public, well-lit places whenever possible;
• Verifying items in person before completing an exchange;
• Bringing a friend or letting someone know where you’re going;
• Not sharing personal financial details (bank passwords, full account numbers, Social Security numbers) with other users;
• Reporting suspicious behavior to us and, where appropriate, to law enforcement.

Rides specifically. When you offer, join, or coordinate a Ride through Mossen:

• For rideshare splits, the actual trip happens through Uber or Lyft using the booking user’s account. Their safety features (driver verification, in-app emergency assistance, trip tracking) apply. Mossen does not operate the trip.
• For carpools in a personal vehicle, you are trusting the driver to be sober, licensed, insured, and reasonable. Mossen does not verify any of these. Ask before you commit if you have concerns.
• Verify the driver and vehicle match the details you were given before you get in.
• Share your ride details with someone you trust before departure. Consider using iMessage Check In, Google Maps trip sharing, Find My, or the Send Ride Details feature within Mossen.
• Do not drive under the influence, distracted, or when too fatigued to drive safely. Do not accept a ride from someone you believe to be impaired.
• Payment coordination for shared rides happens between users directly — Mossen doesn’t collect, hold, or split fares.

These are recommendations, not warranties. Mossen is not responsible for what happens at any meetup, exchange, gathering, or ride coordinated through the Service.

6. Payments between users

Mossen does not process, escrow, or facilitate payments. When money changes hands — in a Splits or Market share, or in a Ride where riders are contributing to a rideshare fare or gas — users arrange payment directly (cash, Venmo, Zelle, PayPal, or whatever they prefer). You are responsible for any taxes, fees, or losses associated with those transactions.

Free shares do not involve payment. Neither do Rides where the driver isn’t asking riders to chip in.

7. Prohibited items and conduct

The following are prohibited on Mossen:

(a) Prohibited items

• Weapons, ammunition, explosives, and their component parts;
• Illegal drugs, drug paraphernalia, and substances restricted under federal or state law;
• Alcohol, tobacco, cannabis, or nicotine products (their sale to the public generally requires a license we can’t verify);
• Prescription medications, medical devices requiring a prescription, and dietary supplements making disease claims;
• Live animals (buy or adopt through licensed shelters or breeders instead);
• Hazardous materials, flammables, corrosives, radioactive materials, biological samples;
• Items recalled by the CPSC, FDA, or another regulatory body;
• Human remains, organs, blood, or other bodily fluids;
• Stolen goods, counterfeit items, or items whose sale violates intellectual property rights;
• Items whose transfer is otherwise prohibited by law (endangered wildlife, artifacts, currency, gift cards exceeding legal limits, etc.);
• Perishable food items you cannot represent as safely stored and handled;
• Any item you don’t own or don’t have the right to transfer.

(b) Prohibited conduct

• Harassment, threats, hate speech, stalking, or doxxing;
• Discriminatory refusal to transact based on protected characteristics under applicable law;
• Scams, fraud, or misrepresentation of items or identity;
• Spam, chain messages, or bulk unsolicited communications;
• Scraping, crawling, reverse-engineering, or automated access to the Service without our written permission;
• Circumventing safety, security, or rate-limiting measures;
• Using the Service to promote or sell commercial goods outside the scope of neighbor-to-neighbor exchange;
• Sharing sexually explicit content, content depicting minors inappropriately, or content that a reasonable person would find grossly offensive;
• For Rides: driving under the influence of alcohol, drugs, or medication that impairs your ability to drive safely; driving without a valid license or insurance; operating an unlicensed commercial transportation service under the guise of a neighborly carpool;
• For Rides: charging riders more than a fair share of the actual trip cost (rideshare fare, gas, tolls) for personal profit;
• Violating any local, state, federal, or international law.

We may remove content, restrict features, or suspend or terminate accounts that violate these rules. Serious or repeated violations may result in permanent bans and reporting to authorities.

8. Your content

You retain all rights to the content you post to Mossen (photos, listings, messages, Stash notes, profile information, etc.). By posting, you grant Mossen a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (only to the extent necessary to display and format the content), and distribute your content solely for the purpose of operating and improving the Service. This license ends when you delete the content or your account, except:

• To the extent needed to comply with legal obligations;
• For messages you’ve sent to other users, which remain visible to those recipients even after you delete them from your account.

You represent that you own or have the rights to post the content you upload, and that your content doesn’t infringe anyone else’s rights.

9. Our content

The Mossen brand, logo, wordmark, app, website, and all related content owned by us (the “Mossen Materials”) are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service as intended and for no other purpose. Don’t copy, modify, distribute, sell, or reverse-engineer the Mossen Materials except as expressly permitted.

10. Third-party services

The Service integrates with third-party providers (Apple, Google, Mapbox, Supabase, etc.). Your use of those providers’ services is subject to their own terms and privacy policies. We’re not responsible for the practices of third parties.

11. Feedback

If you send us ideas, suggestions, or feedback about the Service, we may use them without compensating you or crediting you. This doesn’t obligate us to use them.

12. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access immediately if we believe you’ve violated these Terms, created risk or legal exposure for us, or if we need to for security or legal reasons. We’ll try to give you notice when practical.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law) will survive.

13. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by applicable law, Mossen disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the service will be uninterrupted, secure, error-free, or accurate, or that any content on the service is reliable.

Mossen makes no representation or warranty about the conduct of users, the quality or safety of items exchanged through the service, or the safety of meetups. Any reliance you place on user-generated content is at your own risk.

14. Limitation of liability

To the fullest extent permitted by applicable law, Mossen (and its officers, directors, employees, and agents) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the service, these terms, or any user interaction.

Mossen’s total liability for any claim relating to the service or these terms will not exceed the greater of (a) the amount you paid to Mossen in the 12 months preceding the claim (which for a free service is $0.00) or (b) $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, some of these exclusions or limitations may not apply to you, and our liability will be limited to the fullest extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Mossen and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service; (b) your content; (c) your violation of these Terms or any applicable law; (d) your violation of any third party’s rights; or (e) any exchange, transaction, or interaction you have with another user of the Service.

16. Dispute resolution

(a) Informal resolution first

Most disputes can be resolved informally. Before filing any lawsuit or arbitration, please email us at admin@mossen.app with a description of the dispute and the resolution you would like. We’ll do the same if we have a dispute with you. Both parties agree to try in good faith to resolve the dispute within 60 days of the initial notice before commencing any formal proceeding.

(b) Governing law and venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-laws principles. Any lawsuit or proceeding that arises out of or relates to these Terms or the Service must be filed in a state or federal court located in Multnomah County, Oregon, and both parties consent to the jurisdiction and venue of those courts.

(c) Class action waiver

You and Mossen agree that any dispute will be brought in an individual capacity, and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding, to the extent permitted by law.

17. General

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Mossen regarding the Service.
• Severability. If any part of these Terms is held unenforceable, the rest of the Terms stays in effect.
• No waiver.Our failure to enforce any provision doesn’t waive our right to enforce it later.
• Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms to any successor, affiliate, or acquirer.
• No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Mossen.
• Notices to us. Send legal notices to Mossen LLC, care of Northwest Registered Agent, our registered agent in Oregon, or email admin@mossen.app.

18. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date at the top and, for significant changes, we’ll notify you through the app or by email before the change takes effect. Your continued use of the Service after the change means you accept the updated Terms.
